TERMS AND CONDITIONS

|
Goods accepted by the carrier (hereinafter
called "The Company"), from the owner, consigner or shipper
(hereinafter called "The Customer") will be subject to the following
terms & conditions as mutually agreed.
These conditions will remain valid for the
entire period during wich the Company will be providing services to the
Customer, and will supercede any disposition generally appearing on the
uniform Bill of Lading (also known as a waybill) used in Canada.
- All delivery times are subject to weather,
traffic conditions and/or acts of God
- All shipments must be placed within the
Company's service levels and cut-off times as outlined here:
-Next Business Day by 4:30pm orders must be placed and ready for pick-up
by 4:00pm previous business day.
-Next Business Day by 12:00noon orders must be placed and ready for
pick-up by 3:00pm, previous business day.
-Same Business Day orders must be placed
by and ready for pick-up 10:00am for delivery by 5:00pm Same Business
Day. Orders placed and ready for pick-up between 10:00am to 1:00pm must
be placed on our 4hr REGULAR service to be eligiable for Same Business
Day delivery.
-4hr REGULAR orders must be placed and
ready for pick-up by 1:00pm for delivery by 5:00pm Same Business Day.
-3hr RUSH orders must be placed and ready for pick-up by 2:00pm for
delivery by 5:00pm Same Business Day.
-2hr HOT orders must be placed and ready for pick-up by 3:00pm for delivery
by 5:00pm Same Business Day.
-DIRECT orders are delivered as soon as possibly can. Customer acknowledges
that the time frame can vary depending on traffic, weather and company
network conditions, and must confirm the order with the Company prior
to submission.
- All delivery parameters are within PX
Courier's specified service levels only and will be charged accordingly.
The Company will not be responsible for late shipments that are not
placed within PX Courier specified service levels. The Customer will
solely be responsible to ensure they meet all cut-off times for PX Courier's
specified service levels, and agrees they understand any orders placed
after cut-off times will automatically default to the next day starting
at 8am or when the delivery location opens, whichever is later. (Next
Day cut-off is 4pm, if order is placed at 4:01pm on a Next Day order,
it will default to 8am Next Business Day, for delivery on the Next Business
Day thereafter).
- The Company does not guarantee delivery
times, including but not limited to delivery times for tenders.
- Maximum liability of The Company is $2.00
per pound ($4.41 per KG), up to a maximum of $50.00.
- The Customer has the sole responsibilty
for insuring the goods above the maximum available from The Company
and The Company bears no responsibilty for same.
- Any claims must be forwarded to The Company,
in writing within 10 days from the date of delivery. No liability shall
be recognized by The Company due to improper packaging or improper labelling
of shipments. No claim shall be recognized by the Company for perishable
commodities such as, but not limited to chocolate, fruit, pastry, baked
goods & flowers.
- Fragile shipments must be indicated on
the package and on the waybill and will be transported at 1.5 times
of the requested service rate. No liability shall be recognized by the
company due to improper labelling of fragile shipments.
- A service charge no less that $5.00,
or 1/2 of the delivery service required, whichever equals greater, will
be levied for any pick-up attempt where no shipment is obtained or a
delivery is attempted with an incorrect address, and/or no signature
can be obtained.
- If signature can not be obtained, the
shipment will be returned to The Customer on a Next Day service unless
otherwise indicated with The Company. If attempt to delivery the shipment
is authorized by The Customer, it will be redirected on and charged
a Next Day service unless otherwise indicated with The Company and each
attempt thereafter. All redirects must be authorized with The Company
- A Wrong Address charge will be levied
for any wrong flor or extra floor, and/or wrong unit/suite numbers indicated
on the waybill by The Customer.
- A Late Cancelation charge of $5.00, or
1/2 of the delivery service required, whichever equals greater, will
be levied if The Company's driver is enroute.
- Waiting Time is charged after the first
10 minutes at a rate of $3.00 per five (5) minute increment.
- Cubing may be charged for bulky shipments
at 15 pounds per cubic foot.
- All Tenders/Bids must be stated at the
time of entry with The Company, and be authorized by management of The
Company.
- Rates and services subject to change
without notice.
- Orders placed via telephone will be subject
to an additional charge unless there is a system error, such as internet
outage on the customers or PX Courier's end, or system outage on PX
Courier's end. In the case of a system error, the additional charge
will be waived.
- Collect shipments must be decarled to
The Company at the time the order is placed. If Consignee refused the
charges, the shipment will be automatically charged to The Customer.
If Collect shipments are not declared upon the time the order is placed,
the shipment will be automatically charged to The Customer. If the Consignee
does not have an established account with The Company, and cash or company
cheque is not available to the driver upon delivery, the shipment will
be automatically charged to The Customer including any additional charges
such as, but not limited to Waiting Time if applicable.
- Only cash, or company cheque will be
accepted for non-account holders.
- All deliveries must be wrapped, packed,
and addressed for safe handling.
- Rural Shipments are subject to a Rural
surcharge of $5.00. These areas include, but not limited to: Belcarra,
Chilliwack Lake, Cultus Lake, Cypress Mtn., Deep Cove, Hatzic Lake,
Hope, Horseshoe Bay, IOCO, East Maple Ridge, North Vancouver east of
Berkley Ave, Roberts Bank, Rosedale, Seymour Mtn., SFU, UBC, West Vancouver
west of 22 Ave & north of Upper Levels Hwy, and Yarrow.
- The Company reserves the right to refuse
service to The Customer for any reason without notice.
